Data subject rights
Below is a short extract of the information made available by the Italian Data Protection Authority (Garante) on its official website www.garanteprivacy.it/home/diritti — on that website you can find more information about your privacy rights and further details on how to exercise them. In particular, the Authority makes available two different forms that can be used in the cases set out below, namely:
1) Submitting a request to the Data Controller
…”the Regulation (Articles 15–22) grants important rights regarding the protection of personal data, which can be exercised by contacting the Data Controller (a public body, company, association, party, natural person, etc.).”… “The data subject may submit a request to the Controller without any particular formalities (for example by registered letter, fax, e-mail, etc.) — depending on the data subject’s needs, the request may relate to specific personal data, to categories of data or to a particular processing activity, or to all of the personal data concerning them, however processed.” … The form proposed by the Authority is available below.
2) Lodging a complaint with the Authority
… “A complaint is the tool that allows a data subject to contact the Italian Data Protection Authority to report a breach of the personal-data protection rules (Art. 77 of EU Regulation 679/2016 and Articles 140-bis to 143 of the Italian Personal Data Protection Code) and to request a check by the Authority. The complaint may be signed directly by the data subject or, on their behalf, by a lawyer, an attorney, a body, an organisation or a non-profit association. In such cases a power of attorney must be granted and filed with the Authority together with all documentation useful for assessing the complaint. The complainant may submit the document in whichever way is deemed most appropriate, either by delivering it by hand to the offices of the Authority or by sending: a) registered letter with return receipt addressed to: Garante per la protezione dei dati personali, Piazza Venezia 11, 00187 Rome, Italy; b) certified e-mail (PEC) addressed to: protocollo@pec.gpdp.it. The complaint and any power of attorney must be signed with an authenticated signature, a digital signature, or a handwritten signature (in the latter case, a copy of a valid identity document of the data subject must be attached to the complaint). The form proposed by the Authority is available below.
